Auto insurance is the most common insurance available in Florida, but due to Florida being a “No Fault State” there is a lot of confusion on what “No Fault” means. The term “No Fault” actually refers to the required medical coverage know as Personal Injury Protection (which will pay up to $10,000 for your own personal medical bill, regardless of who is at fault) and does not in anyway mean that a driver will not be considered at fault in an accident.
Did you know that in Florida, in order to register a vehicle you are only required to carry two coverages:
- Property Damage Liability (pays for the other person’s vehicle or property you damage in an accident that is your fault)
- Personal Injury Protection (pays up to $10,000 for you medical bills if you are injured in a car accident regardless of who is at fault)
You cannot get insurance or register a vehicle without these two coverages!
But here is the BOMBSHELL!
In Florida to be legal to drive and operate a vehicle, you do not have to have ANY Bodily Injury Liability coverage (Bodily Injury pays for the other person’s medical bills when they are injured in an accident that you are at fault in). So when you hear someone say they only want the minimum coverage that is required by the State of Florida, this does not include coverage for your medical bills if they hit you. This is one of the reasons that Florida has such a high uninsured motorist rate. Even the State of Florida will verify that you only need PIP & PD (Personal Injury Protection and Property Damage) to be legal to drive. What they don’t tell you is that in order to be legal, at the time of an accident, you are required to have Bodily Injury Liability on your policy at the time of the accident or you will be considered underinsured! Your license will be suspended and you will have to carry a higher form of insurance known as an SR-22 for three years and be personally responsible for paying all the other person’s medical bills!
